Pennsylvania House Bill 2669 (the "Job Automation Disclosure Act") has been referred to the House Labor and Industry Committee and has not been enacted. If enacted, an employer that serves written notice on the Department of Labor and Industry under 29 U.S.C. § 2102(a) (federal plant closing and mass layoff notice) would also have to tell the department, in a form and manner the department prescribes, whether the layoffs in that notice are related to the employer's use of artificial intelligence or another technological change (Section 3). Section 2 defines "artificial intelligence" (including generative AI), "employer" (which covers the Commonwealth and its political subdivisions) and "employee." The department would enforce the act (Section 4(a)). Employers could face civil penalties per day of violation. For employers with no more than 200 employees, the penalty is $500 to $1,000 per day. For employers with more than 200 employees, it is $1,000 to $5,000 per day (Section 4(b)). Seasonal and temporary employees are exempt (Section 5). The department would have to adopt rules, regulations or guidance within six months of the effective date of Section 6 (Section 6). The act would take effect in 60 days (Section 7).
