Pennsylvania House Bill 2787 (Printer's No. 3918) has not been enacted. It was referred to the Education Committee on 2026-09-24, and the record shows it reported as committed and laid on the table on 2026-10-06. If enacted, it would add Section 1323-B to the Public School Code of 1949. The section would bar school entities (school districts, career and technical schools, intermediate units, and charter, cyber charter and regional charter schools) from using AI, AI chatbots or generative AI to provide a service or experience to a student that would constitute the practice of a school-based mental health professional (subsection (a)). Under subsection (b), AI suppliers could not contract with a school entity to provide AI systems programmed to provide such services. Subsection (c) bars a school entity from using an AI mental health system to: diagnose a student's mental health condition; provide psychological or behavioral therapy or counseling; provide individualized treatment or therapeutic intervention; determine or recommend an individualized diagnosis or treatment plan; represent that the AI is, or can substitute for, a school psychologist, counselor or social worker; or provide mental health therapy. Subsection (d) says the section does not prohibit school-based mental health professionals employed by a school entity from using AI for administrative support, subject to FERPA (20 U.S.C. § 1232g). It also does not override collective bargaining agreements under the Public Employe Relations Act. Subsection (e) defines key terms, and Section 2 sets an effective date of 60 days after enactment. The text contains no penalty or enforcement provisions.
