Arizona House Bill 2371 (57th Legislature, 2nd Regular Session, 2026) amends Title 25, Chapter 3, Article 2 of the Arizona Revised Statutes by adding Section 25-332, which governs the use of artificial intelligence-assisted arbitration in divorce proceedings. Under Section 25-332(A), parties may use AI-assisted arbitration only if both parties provide written consent—including consent specifying whether the proceeding will result in a recommendation or a binding determination—and the parties do not share minor children. Section 25-332(B) allows either party to withdraw that consent at any time before a recommendation or binding determination is issued. Section 25-332(C) provides that a binding determination from AI-assisted arbitration may be appealed to the superior court with jurisdiction by filing a notice of appeal within twenty judicial days; on appeal, the superior court reviews the matter de novo as to both law and facts, without consideration of the AI arbitration proceedings, and further appeals are not limited. Section 25-332(D) permits any court with jurisdiction to enter a binding determination from AI-assisted arbitration. Section 25-332(E) defines 'artificial intelligence-assisted arbitration' as a computational system that applies governing laws to disclosed facts, generates recommendations or binding determinations on divorce-related issues, and is not a legal person and does not exercise independent legal authority.
