California Assembly Bill 2412 amends Section 11549.66 of the Government Code to update disclosure requirements for state agencies and departments that use generative artificial intelligence (GenAI) to communicate with the public. Under existing law, the disclaimer requirement applied only when GenAI was used to communicate with a person regarding government services and benefits. This bill broadens the scope to cover all direct public communications, including both individualized messages and general public announcements. The bill defines 'directly communicate' as using GenAI, instead of a natural person, to reach a specific member of the public or to issue a general public announcement, and explicitly excludes using GenAI to assist in drafting a communication from this definition. State agencies must ensure communications include: (1) a prominent GenAI disclaimer—appearing at the start of written letters and emails, displayed throughout chatbot and video interactions, and stated orally at the start and end of audio interactions; and (2) information or a link describing how to contact a human employee of the agency or department.
