Assembly Bill 853 (Chapter 674), signed October 13, 2025, amends the California AI Transparency Act by delaying its original January 1, 2026 operative date to August 2, 2026 (Section 22757.6). The bill adds three new sections to the Business and Professions Code. Section 22757.3.1, operative January 1, 2027, requires 'large online platforms' (public-facing social media, file-sharing, mass messaging platforms, or stand-alone search engines with over 2,000,000 unique monthly users) to detect standards-compliant provenance data in distributed content, display system provenance data through a user interface, and refrain from stripping compliant system provenance data or digital signatures. Section 22757.3.2, also operative January 1, 2027, prohibits 'GenAI system hosting platforms' from knowingly making available any GenAI system that does not place disclosures as required under Section 22757.3. Section 22757.3.3, operative January 1, 2028, requires 'capture device manufacturers' to give users the option to embed latent disclosures in captured content identifying the manufacturer name, device name and version, and time/date of creation, and to embed such disclosures by default. Section 22757.1 adds definitions for 'capture device,' 'capture device manufacturer,' 'large online platform,' 'GenAI hosting platform,' and related terms. Civil penalties of $5,000 per violation per day may be brought by the Attorney General, city attorney, or county counsel under Section 22757.4. All provisions are declared severable under Section 7.
