California Senate Bill 1106 (introduced by Senator Cabaldon, February 13, 2026) amends Civil Code Section 3110 and Government Code Sections 11546.45.5, 11549.64, and 11549.65 to address agentic artificial intelligence. Systems that only respond to direct prompts and lack network egress or shell access are explicitly excluded from this definition. The bill expands the existing comprehensive inventory of high-risk automated decision systems (required under Government Code Section 11546.45.5) to also cover agentic AI systems used, developed, procured, or proposed by any state agency, and requires that the annual report submitted to the Assembly Committee on Privacy and Consumer Protection and the Senate Committee on Governmental Organization include this expanded inventory. Additionally, the bill amends Government Code Section 11549.65 to require that the Office of Emergency Services' risk analysis of threats posed by generative AI to California's critical infrastructure—including threats that could lead to mass casualty events—explicitly include recommendations reflecting changes related to agentic artificial intelligence, its applications, and risk management.
