If enacted, the Distribution of False Sexual Imagery Prohibition Amendment Act of 2025 would amend the Criminalization of Non-Consensual Pornography Act of 2014 to criminalize distributing sexually explicit images, video, or audio of a real, identifiable person that were created or altered with digital technology, including AI. Sec. 2(a) would define "distribute" and "false sexual image" (a sexual image or audio recording a reasonable person would believe depicts the person's real speech or conduct, whose production depended substantially on technical means rather than physical or verbal impersonation). New section 5a, added by Sec. 2(b), would create two offenses. Second-degree (misdemeanor) applies when someone knowingly distributes a false sexual image to someone other than the person depicted, without that person's consent, intending to alarm, sexually abuse, humiliate, harass, or degrade them, to sexually arouse or gratify someone, or to gain financially. The penalty is up to 180 days in jail, a fine, or both. First-degree (felony) applies when those elements are met and the person offends within 5 years of a prior conviction, intends violence or bodily harm, or is reckless about the depicted person being a minor under specified age and age-gap conditions. The penalty is up to 2 years in prison, a fine, or both. Sec. 2(c) would exempt Communications Act of 1934 licensees engaged in regulated activities. Sec. 2(d) makes a conforming change to section 7 of the existing Act. Sec. 3 adopts the committee report's fiscal impact statement. Sec. 5 sets the effective date after Mayoral approval and a 60-day congressional review period. The sponsor's statement says current D.C. law does not cover AI-generated or manipulated sexual images and that the bill aligns D.C. law with the federal Take It Down Act.
