House Substitute No. 1 for House Bill No. 404 (153rd General Assembly) amends Title 14 of the Delaware Code to establish the Artificial Intelligence and Extended Reality in Schools Pilot Program. Administered by the Delaware Department of Education (DOE), the Program invites between 6 and 12 schools—representing diverse demographics and including at least one elementary, middle, and high school from each county and from the City of Wilmington—to procure and implement AI and XR (augmented and virtual reality) products. Under Section 4902, the DOE, in consultation with the Delaware AI Assurance Lab Steering Committee, must form a committee to study best practices from other states and countries, recommend AI and XR products that safeguard student and educator data and comply with state and federal privacy and security guidelines, and finalize contracts in collaboration with the Delaware Department of Technology and Information (DTI) and the Department of Justice (DOJ). Contracts must include penalties for privacy and security violations. The DOE must also provide ongoing technical assistance to participating schools on ethical, safe, responsible, equitable, and effective use of the products. Under Section 4903, participating schools must supply quantitative, qualitative, and personalized metrics to help assess program effectiveness, and the DOE must submit a final report—including analysis and recommendations on expanding or adjusting the Program—to the Governor, General Assembly, and Division of Legislative Services no later than September 30, 2030. Under Section 2, the Act expires 3 years after the end of the 2026-2027 school year unless extended by the General Assembly. The Program aims to improve student outcomes, increase educator efficiency, and support Delaware's priorities in literacy, STEM proficiency, and career readiness.
