Use of Artificial Intelligence in Psychological, Clinical, Counseling, and Therapy Services
Florida SB 344 (2026), introduced by Senator Grall, prohibits licensed mental health professionals from using artificial intelligence (AI) in the direct practice of psychology, school psychology, clinical social work, marriage and family therapy, and mental health counseling. The bill creates two new statutory sections—s. 490.016 and s. 491.019, F.S.—each defining 'artificial intelligence' as any machine-based system that infers from inputs how to generate outputs such as content, decisions, predictions, or recommendations that can influence physical or virtual environments. Under both sections, AI use is permitted only for administrative or supplementary support tasks, including appointment scheduling, drafting non-therapeutic logistics communications, billing and insurance processing, patient record management, and operational data analysis. AI may also be used to record or transcribe sessions, provided the practitioner obtains written, informed consent at least 24 hours before services are rendered. These restrictions apply to licensees under s. 490.016 and to licensees, registered interns, and certificateholders under s. 491.019. The act takes effect July 1, 2026.
