"Fair Business Practices Act of 1975"; any person from facilitating noncompete agreements between residential rental property owners or managers, including by use of algorithmic coordinating functions; prohibit
This Georgia bill amends the Fair Business Practices Act of 1975 (Part 2 of Article 15, Chapter 1, Title 10 of the Official Code of Georgia Annotated) to prohibit two related practices in the residential rental market. First, it bans any person from facilitating noncompete agreements among residential rental property owners or managers, including through the use of algorithmic coordinating functions. Second, it prohibits rental property owners or managers from setting or adjusting rental prices, lease renewal terms, occupancy levels, or other lease terms and conditions based on recommendations generated by software, data analytics services, or algorithmic devices. The bill provides definitions relevant to these prohibitions, specifies an effective date and applicability provisions, and repeals any conflicting laws.
