Relating To Artificial Intelligence.
Hawaii H.B. 2357 (H.D. 1), introduced in the Thirty-Third Legislature (2026), would add a new chapter to the Hawaii Revised Statutes governing 'artificial intelligence music artists.' Section -1 defines key terms: 'artificial intelligence' as a machine-based system that infers from inputs how to generate outputs influencing real or virtual environments; 'artificial intelligence music artist' as a non-natural-person persona created through AI and marketed or promoted as a musical performer or recording artist; and 'music streaming platform' as any public-facing website, application, or digital interface offering a catalogue of music or audio content. Section -2 prohibits music streaming platforms from hosting, distributing, or otherwise making available in Hawaii any music performed or attributed to an artificial intelligence music artist. Section -3 grants the Department of the Attorney General exclusive enforcement authority and the power to adopt rules under chapter 91. Violations are classified as an unfair method of competition and an unfair and deceptive act or practice under section 480-2. The act carries an effective date of July 1, 3000, which effectively renders it a placeholder or indefinitely delayed measure.
