Hawaii House Bill 2607 (33rd Legislature, 2026) amends Chapter 482P-1 of the Hawaii Revised Statutes, which governs publicity rights, to address artificial intelligence deepfakes. Section 1 adds two new definitions: 'artificial intelligence,' which cross-references the meaning established in section 11-303, and 'artificial intelligence deepfake,' defined as any image, audio, video, or other media that is either entirely AI-generated and would falsely appear authentic to a reasonable person, or materially altered by AI in a way that would cause a reasonable person to have a fundamentally different understanding of the media compared to an unaltered version. Section 1 also expands the existing definition of 'likeness' to explicitly include 'artificial intelligence deepfake' alongside images, photographs, paintings, sketches, models, and diagrams. By incorporating deepfakes into the definition of likeness, the bill extends existing publicity-rights protections to cover unauthorized AI-generated or AI-altered representations of a person's face or body. Section 2 provides that the Act does not affect rights, duties, penalties, or proceedings that arose before its effective date. Section 4 provides that the Act takes effect upon approval.
