Hawaii S.B. 2947 (33rd Legislature, 2026) establishes a comprehensive wildfire insurance consumer-protection framework within Chapter 431, Hawaii Revised Statutes, by adding a new part to Article 10E. Under Section 431:10E-B, insurers using wildfire risk scores must disclose upon request the current score, its range, the model creator, the date last updated, and plain-language key adverse factors within 30 calendar days. Section 431:10E-C requires insurers to file descriptions of wildfire risk models, catastrophe models, or scoring methods with the Insurance Commissioner, including actuarial justifications for mitigation discounts, and mandates that property-specific and community-level mitigation actions be either incorporated into models or reflected through premium discounts and adjustments. Section 431:10E-D requires insurers to maintain a public website describing available mitigation discounts and the appeal process, to send standardized written notices to applicants and policyholders at application, renewal, nonrenewal, and annually, and to acknowledge appeals within 10 calendar days and provide a written decision within 30 calendar days. Section 431:10E-E authorizes insurers to offer benefits or premium reductions for wildfire risk-preventative measures such as ignition-resistant materials, defensible space, fire alarms, and compliance with the International Wildland-Urban Interface Code, with required filings to the commissioner. Section 3 amends Section 431:13-103 to clarify that wildfire mitigation benefits and premium reductions under Section 431:10E-E are not prohibited rebates. Section 431:10E-F empowers the commissioner to adopt rules, investigate compliance, and coordinate with state and county agencies. Section 431:10E-G requires annual legislative reports on compliance trends, appeals data, mitigation discount utilization, and recommendations. Section 4 appropriates funds from general revenues for fiscal year 2026-2027 for the Department of Commerce and Consumer Affairs to implement the framework. The Act takes effect July 1, 2026.
