Idaho Senate Bill 1227 became law as Session Law Chapter 71, effective July 1, 2026. It adds a new Chapter 70 to Title 33, Idaho Code, on generative AI in K-12 public education. Section 33-7001 states the legislature's intent to protect student privacy, protect the role of the educator, promote human-centered learning, and increase transparency. Section 33-7002 defines "generative artificial intelligence" and "generative artificial intelligence in education," and says human judgment remains the final authority. Under 33-7003, the State Department of Education must develop a statewide framework, subject to State Board of Education approval. The framework must prioritize human oversight, transparency, safety, and data security. It must ensure that no generative AI replaces or eliminates a human teacher. It must also cover instructional integration, academic integrity, digital citizenship, and accessibility. The framework is to be reviewed and updated with input from two House members, two Senate members, educators, industry partners, and workforce representatives. Section 33-7004 requires every school district and public charter school to adopt a policy on student and employee use of generative AI. The policy must align with the framework, define appropriate and prohibited uses, include safeguards for privacy, data security, accessibility, and academic integrity, and comply with state and federal law, including FERPA, CIPA, and COPPA. Section 33-7005 directs the Department to develop and recommend K-12 generative AI literacy standards, assessment guidelines, and an educator professional development plan. Section 33-7006 requires a generative AI guidance document for parents and guardians. Section 33-7007 requires AI tools procured by districts and charter schools to comply with data privacy laws. It also requires vendors to disclose whether their products use machine learning, predictive analytics, or generative AI, and to give assurances on data protection, algorithmic transparency, and responsible use. The Department may create an approved-tool list or model procurement guidelines. Section 33-7008 lets the State Board of Education adopt implementing rules, subject to legislative approval. Section 2 declares an emergency and sets the July 1, 2026 effective date.
