Illinois HB3567, the Meaningful Human Review of Artificial Intelligence Act, prohibits State agencies—or any entity acting on their behalf—from using automated decision-making systems without continuous meaningful human review when performing functions related to public assistance benefits, functions that materially affect individual rights, civil liberties, safety, or welfare, or functions that affect statutory or constitutional rights (Section 10). 'Automated decision-making system' is defined in Section 5 as software using algorithms, computational models, or AI techniques to automate, support, or replace human decision-making, but excludes basic tools like calculators or spellcheck. 'Meaningful human review' requires trained individuals who understand the system's risks and limitations and have authority to approve, deny, or modify its decisions. Section 10(c) includes worker protections, prohibiting automated systems from displacing employees, reducing wages or benefits, or transferring duties currently or ordinarily performed by State workers, and preserving collective bargaining rights. Section 15 requires agencies to conduct impact assessments before deploying any such system, signed by those responsible for meaningful human review. Assessments must cover: system objectives and their evaluation; underlying algorithms and training data; testing for accuracy, fairness, bias, and discrimination across protected characteristics; cybersecurity and privacy risks; public health and safety risks; potential misuse; data handling; and notification mechanisms for affected individuals. If an assessment finds discriminatory or biased outcomes, the agency must cease use of the system (Section 15(b)). Under Section 20, assessments must be submitted to the Governor, Senate President, and House Speaker at least 30 days before deployment and published on the agency's website, with limited redaction allowed for health, safety, privacy, or security reasons.
