Illinois SB0150, introduced January 17, 2025 by Sen. Steve Stadelman, amends the Election Code by adding Section 9-9.6 to require clear and conspicuous disclosure when a qualified political advertisement — defined as any paid political ad containing images, audio, or video generated in whole or substantially by artificial intelligence — is created, published, or distributed. Under Section 9-9.6(b), graphic ads must include the disclosure in text at least as large as the majority of the ad's text; audio ads must include a spoken disclosure lasting at least 3 seconds at the beginning or end; and video ads with audio must display the disclosure for at least 4 seconds and include a spoken disclosure of at least 3 seconds. Civil penalties under Section 9-9.6(c) are up to $250 for a first violation and up to $1,000 per violation for subsequent offenses, with each separately distributed ad constituting a separate violation. Exceptions under Section 9-9.6(d) include bona fide news broadcasts that acknowledge AI-generated content, broadcast stations paid to air political ads, distribution platforms with written disclosure policies communicated to advertisers, satire or parody, and FCC-regulated businesses. Distribution platforms are shielded from liability if they can show they notified distributors of their disclosure requirements, per Section 9-9.6(e).
