STATE GOVT AI ACT
Illinois SB1366, introduced January 28, 2025, creates the State Government AI Act (Section 1). Under Section 10, the Department of Innovation and Technology must adopt rules governing the development, procurement, deployment, use, and assessment of AI by state government agencies before January 1, 2028, with the goal of protecting the health, welfare, and safety of Illinois residents. The Department may consult the Generative AI and Natural Language Processing Task Force established under Section 1-80 of the Department of Innovation and Technology Act while developing these rules. Section 15 prohibits any state government agency from deploying or using AI beginning January 1, 2028, unless expressly permitted by those rules. Section 20 requires each state agency to submit an annual impact assessment report on AI to the Department by July 1, 2028, and each year thereafter; the Department must then submit a consolidated AI impact report to the General Assembly and Governor by January 1, 2029, and annually thereafter. The Act takes effect immediately upon becoming law (Section 99).
