Illinois SB2259, introduced February 7, 2025 by Sen. Laura Fine, amends the Medical Practice Act of 1987 by adding Section 67 (225 ILCS 60/67 new) to regulate the use of generative artificial intelligence (AI) in patient communications. Under the new section, any health facility, clinic, physician's office, or office of a group practice that uses generative AI to produce written or verbal patient communications about patient clinical information must include two required elements: (1) a clear disclaimer notifying the patient that the communication was generated by generative AI, formatted appropriately for the medium (prominently at the beginning for written letters and emails, continuously displayed for chat-based telehealth and video, and stated verbally at the start and end for audio), and (2) clear instructions on how the patient can reach a human health care provider or appropriate staff member. The bill exempts AI-generated communications that are read and reviewed by a licensed or certified human health care provider from these requirements. Violations by licensed health facilities or clinics are subject to penalties established by the Department of Financial and Professional Regulation by rule, while violations by physicians are subject to penalties determined by the Illinois State Medical Board. The bill explicitly excludes administrative communications such as appointment scheduling and billing from the definition of 'patient clinical information.'
