Illinois SB2993, introduced January 27, 2026 by Sen. Rachel Ventura, amends the Medical Practice Act of 1987 (225 ILCS 60) to regulate the use of artificial intelligence in prescribing medication. Section 5 amends Section 2 to define 'artificial intelligence' by cross-referencing the meaning given in Section 2-101 of the Illinois Human Rights Act. New Section 7.3 prohibits any person licensed under the Act from allowing artificial intelligence to prescribe medication unless the licensed person maintains full control and responsibility for the prescription. Violations of Section 7.3 carry a civil penalty of up to $10,000 per violation, assessed by the Department of Financial and Professional Regulation following a hearing under Section 2105-100 of the Department of Professional Regulation Law; penalties must be paid within 60 days of the Department's order. The Department is authorized to investigate actual, alleged, or suspected violations of Section 7.3. Amended Section 10 adds a new subsection (D) requiring the Department to adopt rules regarding the authorized use of artificial intelligence to prescribe medication in accordance with Section 7.3. The bill takes effect immediately upon becoming law.
