Illinois SB3571, introduced February 5, 2026 by Sen. Mike Simmons, amends the Illinois Worker Adjustment and Retraining Notification Act (820 ILCS 65) to require employers to disclose artificial-intelligence-related job impacts when reporting the reason for a mass layoff or closing. Specifically, under amended Section 10 (820 ILCS 65/10), new subsection (b-5) requires employers to disclose the number of employees laid off substantially due to AI replacement or automation of their job functions. The Director of Labor may by rule require employers to report additional AI-related job-impact information. The term 'artificial intelligence' is defined by reference to subsection (N) of Section 2-101 of the Illinois Human Rights Act. Amended Section 45 (820 ILCS 65/45) updates the annual advisory notice that the Department of Commerce and Economic Opportunity sends to qualifying employers to include information about the requirement to report the reason for a mass layoff or closing. New Section 47 (820 ILCS 65/47) requires that if the Department of Commerce and Economic Opportunity issues any public report disclosing mass layoffs or closings, that report must include the reason for each layoff or closing, including whether it is substantially due to artificial intelligence.
