MARRIAGE ACT-EVIDENCE
Illinois SB3901, introduced February 6, 2026 by Sen. Mary Edly-Allen, amends Section 105 of the Illinois Marriage and Dissolution of Marriage Act (750 ILCS 5/105) to address the misuse of artificial intelligence in family law proceedings. The bill establishes legislative intent that AI misuse—including fabrication of fake, manipulated, or non-existent evidence—can have a profound effect in family law cases, which are particularly sensitive due to the emotional nature of the proceedings. A new subsection (c-5) requires courts to review evidence in proceedings under the Act pursuant to Supreme Court Rule 901 to evaluate whether proposed evidence may have been generated by artificial intelligence, using the definition of 'artificial intelligence' as provided in the Illinois Human Rights Act. The review is triggered on the request of either party.
