Ban on employer use of automated decision systems.
This bill prohibits employers from relying exclusively on an automated decision system (ADS) when making employment-related decisions affecting covered individuals. Employers may only use ADS output in employment decisions if certain specified conditions are met, and they are barred from discriminating or retaliating against any covered individual who exercises rights under the bill. Employers that use or plan to use ADS output in employment decisions must meet disclosure requirements. The state Department of Labor is authorized to take enforcement actions for violations, and covered individuals or labor organizations may bring civil actions against non-compliant employers.
