Opposing the federal preemption of state laws that regulate artificial intelligence.
House Resolution No. 6023 is a Kansas House resolution that has been introduced and referred to the Committee on Legislative Modernization. It has not been adopted. If adopted, it would be a statement of position and would not change state law. It would express the House's strong opposition to any federal legislation, executive order or federal policy that would preempt, freeze or restrict Kansas from enacting, enforcing or modifying AI laws. It would also oppose any temporary or permanent suspension of Kansas's authority to regulate AI in any sector. It lists areas of traditional state responsibility: election administration and AI deepfakes, state courts, policing and AI surveillance/biometrics, professional licensing, employment discrimination, housing discrimination, healthcare AI, consumer protection against AI fraud and identity theft, data center environmental and land use rules, and children's privacy and AI companion apps. The resolution would reject federal preemption proposals that: lack a clear exemption for state criminal enforcement against AI-enabled crimes; provide no replacement federal protections or minimum standards; use ambiguous AI definitions; allow private enforcement of restrictions on states; condition federal funding, including BEAD broadband funds, on Kansas not regulating AI; or try to preempt through executive order. It would affirm Kansas's constitutional authority to regulate AI. It states that it does not endorse all AI regulations and does not oppose reasonable federal AI standards that preserve meaningful state authority. The Secretary of State would send enrolled copies to the Kansas congressional delegation, the President, congressional leaders and relevant committee leaders, all state governors and legislative leaders, and national media.
