This Kentucky bill amends KRS 367.3611 to add four new definitions—'automated-decision system,' 'base price,' 'individualized data,' and 'surveillance pricing'—and amends KRS 367.3617 to prohibit any controller subject to the Kentucky Consumer Data Protection Act from engaging in surveillance pricing or from using an automated-decision system to offer, set, or display a price for a good or service to a consumer when that price is based, in whole or in part, on individualized data about that consumer. The bill provides that the Act may be cited as the 'Kentucky Price Fairness Act.'
