AN ACT relating to mental health chatbots.
This Kentucky bill creates new sections in KRS Chapter 367 to regulate suppliers of mental health chatbots and protect consumers who use them. It defines key terms and establishes rules for how suppliers must handle individually identifiable health information, including specific prohibitions and exceptions. Suppliers are prohibited from advertising a specific product or service unless that product or service is clearly and conspicuously disclosed to the user. The bill requires suppliers to clearly and conspicuously disclose that the mental health chatbot is artificial intelligence, and specifies when that disclosure must appear. It provides an affirmative defense to liability, along with the requirements a supplier must meet to claim that defense. Enforcement authority is granted to the Attorney General. The bill includes a severability provision and may be cited as the Artificial Intelligence in Mental Health Act.
