Louisiana HB 157 (2026 Regular Session) has not been enacted. It is in the House Committee on Civil Law and Procedure. If enacted, it would amend Louisiana's existing law on property rights in an individual's identity (R.S. 51:470.2 through 470.6) to address misuse of artificial intelligence. R.S. 51:470.2(3) would define "artificial intelligence" as an artificial system developed in computer software, physical hardware, or another context that solves tasks requiring human-like perception, cognition, planning, learning, communication, or physical action. The bill would add a new R.S. 51:470.4(D). It would make it a violation to use AI to generate or create audiovisual work of an individual's identity for a commercial purpose without first getting consent from the individual or the individual's authorized representative. "Identity" covers name, voice, signature, photograph, image, likeness, or digital replica. "Commercial purposes" covers use on or in connection with products or services, advertising, and fundraising. For AI-related claims, R.S. 51:470.3(F) would provide that a claim cannot be asserted unless the violation occurs after August 1, 2026. R.S. 51:470.6(B)(2) would provide that the property rights vest on August 1, 2026, if the claims result from AI misuse of identity. Existing remedies would stay in place. These include the greater of $1,000 or actual damages, disgorgement of profits, temporary restraining orders and injunctions, and discretionary attorney fees to the prevailing party. Jurisdiction provisions and the special motion to strike protections under Code of Civil Procedure Article 971 for expressive works and media defendants would also stay. The bill relettered those subsections (now E through H in R.S. 51:470.4) and made technical wording changes.
