Louisiana HB 197 (2026 Regular Session) has not been enacted. It is in the House Committee on Health and Welfare. If enacted, it would add R.S. 37:22.1 to regulate how healthcare providers use artificial intelligence (AI). Under Subsection B, providers could use AI for administrative or analytical tasks. Examples include preparing records and notes, scheduling and reminders, billing and insurance claims, analyzing anonymized data to track progress or trends, organizing external resources or referrals, and drafting general therapy-logistics communications that give no therapeutic advice. Under Subsection C, providers could not use AI to make treatment or diagnosis decisions, interact directly with a patient in any form of communication, or generate a therapeutic recommendation or treatment plan unless a licensed healthcare professional reviews and approves it. Under Subsection D, a provider found in violation would pay the Louisiana Department of Health a civil penalty of up to $10,000 per violation. The department could investigate complaints against providers it licenses or certifies. It could also refer complaints to the relevant licensing board or agency. It would have to adopt implementing rules. Subsection A defines "artificial intelligence," "department," "healthcare professional," and "healthcare provider."
