Louisiana HB 295 (2026 Regular Session) has not been enacted. It is in the House Commerce Committee. If enacted, it would create the "Guidelines for User Age-Verification and Responsible Dialogue Act" (R.S. 51:1771–1778). Under R.S. 51:1774, no person could knowingly or with reckless disregard design, develop, or deploy an AI chatbot capable of soliciting or inducing a minor into sexually explicit conduct, creating or sending sexually explicit visual depictions for a minor, or encouraging or coercing a minor to commit suicide, self-injury, or imminent physical or sexual violence. The penalty would be up to one year in prison (with or without hard labor), a fine of up to $100,000, or both. R.S. 51:1775 would require covered entities (those who own, operate, or make available chatbots to people in Louisiana) to: require user accounts; verify the age of new and existing users with reasonable age-verification measures (self-attestation or a birth date alone is not enough); freeze unverified accounts; bar verified minors from AI companions; limit and protect age-verification data, including a ban on selling or sharing it; and have chatbots disclose at the start of each interaction and every 30 minutes that they are AI, not claim to be human or a licensed professional, and not give medical, legal, financial, or psychological advice. Third-party verifiers may be used, but liability stays with the covered entity. R.S. 51:1776 would add civil fines of up to $100,000 per violation, with each instance counted separately. R.S. 51:1777 would let the attorney general investigate, subpoena, seek injunctions, restitution, and civil penalties, and make rules. R.S. 51:1778 would let harmed parties seek exemplary damages, attorney fees, and costs. Section 2 says the Act does not preempt state laws that protect minors more. Under Section 3, it would take effect on the governor's signature or by lapse of time.
