Louisiana House Bill 639 (Act No. 559, 2026 Regular Session) amends R.S. 18:1463.1 to strengthen disclosure requirements for telephone campaign communications that use artificial intelligence. Under the amended Section D, no person may make or cause to be made any telephone call or automated call that is created using AI and uses the voice of a public figure—including an elected official or limited public figure—without providing a clear and understandable disclosure at the very beginning of the call that it was created using artificial intelligence. Section E adds and clarifies key definitions, including 'artificial intelligence' (as defined in R.S. 14:73.14), 'limited public figure' (a non-household-name person at the forefront of a public controversy), and 'public figure' (a person involved in important public questions or of notable prominence). New Section F exempts from liability interactive computer services (per 47 U.S.C. 230), internet service providers, cloud providers, cybersecurity providers, information service providers, telecommunications service providers, and radio or television broadcasters—including cable and satellite operators—for content provided by another person. Section G sets civil penalties of up to $2,500 for a first violation and up to $5,000 for subsequent violations. New Section H and the amendment to R.S. 42:1132(D) formally assign the Louisiana Board of Ethics the authority to administer and enforce these provisions.
