Louisiana Senate Bill 110 (Act 211, 2026) amends R.S. 14:81.1, the state's child sexual abuse materials (CSAM) law, to address AI-generated content. Under new R.S. 14:81.1(A)(3), it becomes a criminal offense to use an image of a child under 17 years old with the intent to train an artificial intelligence model to produce child sexual abuse materials. New R.S. 14:81.1(A)(4) clarifies that it is not a required element of the offense that the child depicted in the CSAM be a natural (real) person, meaning AI-generated depictions are covered. The bill also updates R.S. 14:81.1(G) to extend the existing evidentiary framework—by which a trier of fact uses physical and contextual factors to determine whether a depicted person was under 17—to also apply when determining whether an image used to train an AI model depicts someone who appears to be under 17. The enumerated factors include body growth, bone development, pubic or body hair development, development of sexual organs, contextual information, and expert testimony.
