Prohibits the use of deepfake material against students enrolled in K-12. (8/1/26)
Louisiana Senate Bill 346 (Act No. 496) enacts R.S. 17:416.14.1 to prohibit the use of deepfake material against K-12 students in elementary and secondary schools. Under Section 416.14.1(A), no student, faculty member, administrative staff member, or other school employee may use deepfake material against a K-12 student with the intent to coerce, harass, intimidate, or maliciously disseminate or sell such material. Section 416.14.1(B) defines 'deepfake' as any audio or visual media in electronic format—including motion picture film or video recordings—that is created, altered, or digitally manipulated to falsely appear to a reasonable observer as an authentic record of an individual's actual speech or conduct, or that replaces an individual's likeness with another's. The definition explicitly excludes material of political, public interest, or newsworthy value (including commentary, criticism, satire, or parody), as well as material containing a clear disclosure visible throughout the recording that would cause a reasonable person to understand it is not a record of a real event. Section 416.14.1(C) directs the State Board of Elementary and Secondary Education, in collaboration with the state Department of Education, to develop and adopt rules and regulations to implement the law.
