Maine LD 230 (H.P. 153, 132nd Legislature) did not pass. It was reported out "ought not to pass" (LTW) by the Criminal Justice and Public Safety Committee and placed in the legislative files (dead) on 2025-05-28. Had it passed, it would have created a new civil-recovery chapter, 14 MRSA c. 765, §9101. Under that section, a person could not use or display a minor's picture, image or likeness in an advertisement without written permission from the minor's parent or guardian (§9101, sub-§1). A person also could not use or display in an advertisement an image or likeness of a specific minor that was artificially generated by technology, including AI (§9101, sub-§2). A minor, or the minor's parent or guardian, could sue for actual, compensatory and punitive damages and injunctive relief. A prevailing plaintiff would be entitled to reasonable attorney's fees and court costs, including expert witness fees (§9101, sub-§3). The bill also would have amended the Maine criminal code on dissemination of sexually explicit material (17-A MRSA §283, sub-§1, ¶A and ¶C). The amendments extend the offense to material that, through AI technology, is designed to artificially depict a person under 16 (Class C crime) or a minor under 12 (Class B crime) engaging in sexually explicit conduct (Secs. 2 and 3).
