Health insurance; use of artificial intelligence prohibited in the utilization review process.
Minnesota H.F. No. 1838 has not been enacted. It was introduced on 2025-03-03 and referred to the Committee on Commerce Finance and Policy, and the record shows its outcome as "committee". If enacted, it would ban the use of artificial intelligence in health insurance utilization review. Section 1 would amend Minnesota Statutes 2024, section 62M.02, by adding Subd. 2a. That subdivision would define "artificial intelligence" by reference to United States Code, title 15, section 9401. Sec. 2 would create a new section, [62M.20] Prohibition on Artificial Intelligence. It would state that the use of artificial intelligence is prohibited in utilization review. It would also bar a utilization review organization from using artificial intelligence in any part of its review, evaluation, determination, or appeals processes.
