Mississippi Senate Bill 2075 (2026 Regular Session), introduced by Senator Johnson, criminalizes the unlawful dissemination or publication of intimate or non-intimate images or audio that have been created or altered through digitization—including by artificial intelligence, machine learning, or other computer-generated means—when shared with intent to harm the emotional, financial, or physical welfare of another person without that person's consent. Section 1 defines key terms including 'digitization,' 'disseminate,' 'publish,' 'intimate part,' and 'sexual conduct.' Section 2 addresses intimate images or audio (those depicting exposed intimate parts or sexual conduct): adults 21 or older convicted of a first offense face felony penalties under Section 97-29-63; offenders under 21 face a misdemeanor with a fine up to $2,500 and/or up to one year imprisonment; repeat offenders (second or subsequent offense at least 30 days after a prior offense) face felony penalties of up to $5,000 and/or up to three years in state prison. Section 3 covers non-intimate digitized images or audio shared with harmful intent without consent, making such conduct a misdemeanor punishable by up to $2,500 and/or up to one year imprisonment. Section 4 clarifies these penalties are in addition to any other applicable criminal penalties. Section 5 provides exceptions for law enforcement reporting, legal proceedings, medical treatment, voluntary public exposure, legitimate public purpose, and internet service or cloud providers. The act takes effect July 1, 2026, per Section 6.
