North Dakota House Bill 1167 became law after being signed by the Governor on April 10, 2025. Section 1 adds a new section to chapter 16.1-10 of the North Dakota Century Code on the use of artificial intelligence in political content. Under subsection 1, any action taken for a political purpose must prominently state the disclaimer "THIS CONTENT GENERATED BY ARTIFICIAL INTELLIGENCE." This applies to communications and political advertising for or against a candidate, political committee, or political party. It also applies to content promoting passage or defeat of initiated or referred measures or petitions. It covers images, graphics, videos, audio, text, or other digital content created wholly or partly with AI to visually or audibly impersonate a human. Subsection 2 exempts content that uses AI only for text generation, grammar correction, spelling checks, stylistic editing, or enhancing existing content without creating a new impersonation of human likeness or voice. Subsection 3 defines "artificial intelligence" as a machine-based system that can create images, graphics, video, audio, text, and other digital content from human-defined objectives or data patterns. The definition excludes systems explicitly programmed with rules, and tools designed solely to help with grammar, spelling, or word suggestions without generating human likeness or voice. The text does not state any penalties or an enforcement mechanism.
