New Hampshire House Bill 1612-FN, introduced for the 2026 session, amends RSA 358-A (the Consumer Protection Act) by adding a new subdivision on rental property price fixing. Under new section RSA 358-A:14, the use of any type of price-fixing software by any landlord is declared an unfair method of competition and a deceptive act or practice in violation of RSA 358-A. Any person who suspects a landlord of using price-fixing software may file a consumer complaint with the Department of Justice's Consumer Protection and Antitrust Bureau, which is required to investigate such complaints. The bill takes effect January 1, 2027. The fiscal note indicates no new funding or positions are authorized, but the Department of Justice estimates the bill would require one additional full-time unclassified attorney at a cost of $72,000 in FY 2027 (half-year), $138,000 in FY 2028, and $140,000 in FY 2029, funded from the Consumer Protection Fund if the position is authorized.
