"GAI Accountability Act;" imposes civil penalties on generative artificial intelligence platforms engaging in harmful activity, including exploitation of children.
New Jersey Assembly Bill 5090, the "GAI Accountability Act," was introduced May 14, 2026 and referred to the Assembly Science, Innovation and Technology Committee. It has not been enacted. If enacted, it would add a new section to Title 56 of the New Jersey Statutes. It would make owners, operators, and developers of publicly accessible generative AI platforms civilly liable if they fail to prevent the platform from (1) engaging in conduct that would be murder, assault, theft by deception, theft by extortion, endangering the welfare of children, or creating child sexual abuse or exploitation material if a human did it, or (2) providing information that facilitates a user's commission of one of those crimes, where a human doing so would be aiding or abetting. The second category does not apply if the information is publicly accessible in a substantially similar form from a source other than a GAI platform. The bill covers businesses that operate in or are based in New Jersey, or that make their platforms accessible to New Jersey residents. Section 1.c provides an affirmative defense if the party used reasonable efforts to prevent a violation. Section 1.d sets a civil penalty of $20,000 per violation, proven by a preponderance of the evidence, and only the Attorney General can bring an enforcement action. Section 2 makes the act take effect on the first day of the fourth month after enactment.
