Restricts use of certain artificial intelligence generated communications in election campaigns.
New Jersey Senate Bill 3702 (introduced February 24, 2026, and referred to the Senate State Government, Wagering, Tourism & Historic Preservation Committee) has not been enacted. If enacted, it would restrict AI-generated communications in election campaigns. It would apply to communications paid for or financed by candidate committees, joint candidates committees, political committees, continuing political committees, independent expenditure committees, political party committees, legislative leadership committees, any other group, or any person. Under section 1(a), (1) communications that aid or promote the nomination, election, or defeat of a candidate, or provide political information on a candidate, and that were created or altered using AI could not be published, circulated, broadcast, or made publicly available within 90 days before an election. (2) Any communication made public using AI would have to be clearly labeled "Artificial intelligence was used in creating this message." (3) Communications could not contain AI-created or AI-altered deceptive audio or visual media that features an opposing candidate for the same office and portrays that candidate in a demonstrably false, fraudulent, or defamatory way. Section 1(b) defines "artificial intelligence," "communication," and "deceptive audio or visual media." Under section 1(c), a violation is a crime of the fourth degree, in addition to any other penalty. The bill's statement says a fourth-degree crime is punishable by up to 18 months' imprisonment, a fine of up to $10,000, or both. Under section 1(d), the Election Law Enforcement Commission would adopt implementing rules under the Administrative Procedure Act. Under section 2, the act would take effect on the 60th day after enactment.
