New Jersey Senate Bill 3883 (introduced March 12, 2026 and referred to the Senate Education Committee) has not been enacted. If enacted, it would require school district boards of education, and boards of trustees of charter schools or renaissance school projects, that use a surveillance system with artificial intelligence capabilities to adopt a policy on its use. The covered systems include video surveillance systems, x-ray machines and body scanners. Under section 1(a), the policy must at a minimum: (1) include information on the installed surveillance system; (2) identify the type of information collected; (3) explain how the board plans to use the information; (4) address how access to the information will be provided, in compliance with State and federal student records law and the Uniform State Memorandum of Agreement Between Education and Law Enforcement Officials; and (5) require prominent public signage in buildings and on school grounds saying an AI-capable surveillance system is in use. Under section 1(b), boards that use video surveillance must also comply with section 1 of P.L.2017, c.119 (C.18A:41-9). The statement describes that law as requiring a memorandum of understanding with law enforcement for video equipment that can stream live video wirelessly to remote locations. Section 1(c) requires the policy to be distributed to parents and guardians. Section 1(d) defines "artificial intelligence" broadly, to include visual perception, speech recognition, decision-making, translation and generative AI. Under section 2, the act would take effect immediately and first apply in the first full school year after enactment.
