New Jersey Senate Bill 4754 (introduced October 5, 2026 and referred to the Senate Commerce Committee) has not been enacted. If enacted, it would expand the state's existing bans on the unauthorized practice of a profession or occupation (under Title 45 of the Revised Statutes or Division of Consumer Affairs regulations) to cover content produced by artificial intelligence or generative AI. Under section 1.a., anyone who develops or deploys an AI or generative AI system would be considered to have engaged in unauthorized practice if content is produced in that manner. Section 1.b. would make title-protection laws, which bar using terms, letters, or phrases that imply a license, registration, or certification, enforceable against developers or deployers whose AI systems use those terms in advertising or functionality. Section 1.c. would exempt licensed professionals in good standing in the State who use AI in their practice, provided any AI-produced content carries a disclaimer that (1) the communication was generated by generative AI and (2) gives clear instructions for contacting a human professional or employee. Under section 1.d., the Director of the Division of Consumer Affairs or the relevant professional board may seek an injunction or restraining order. Under section 1.e., after notice and a hearing, violators must cease and desist and face penalties of up to $10,000 for a first offense and up to $20,000 for each later offense. Section 1.f. makes these proceedings additional to other remedies, including those under section 10 of P.L.1978, c.73 (C.45:1-23). Section 1.g. defines "artificial intelligence" and "generative artificial intelligence." Under section 2, the act would take effect immediately.
