New Jersey Senate Bill 4758 (introduced October 5, 2026 and referred to the Senate Commerce Committee) has not been enacted. If enacted, it would add a new law to Title 56 of the Revised Statutes requiring operators of AI companions to tell users they are not talking to a human. Section 1 defines an "AI companion" as a generative AI system designed to simulate a sustained human or human-like relationship (intimate, romantic, or platonic). It must do this by (1) retaining information from prior interactions or preferences to personalize the experience, (2) asking unprompted emotion-based questions, and (3) sustaining ongoing dialogue about personal matters. Section 2 would require operators to give a clear and conspicuous notification, verbally or in writing, at the start of any AI companion interaction. The notification would repeat at least every three hours during continued interactions. Section 3 would impose a civil penalty of $15,000 per violation, collected in a summary proceeding under the Penalty Enforcement Law of 1999, P.L.1999, c.274 (C.2A:58-10 et seq.). The Superior Court and municipal court would have jurisdiction. Section 4 makes the act effective immediately.
