Nevada Assembly Bill 271 (2025) did not pass. It was referred to the Committee on Legislative Operations and Elections, and no further action was allowed under Joint Standing Rule No. 14.3.1 on 2025-04-12. Had it become law, it would have done the following. (1) Section 5 would have barred any equipment used for voting, ballot processing or ballot counting from using artificial intelligence. This covers tabulators, ballot marking devices, signature-checking devices for mail ballots, and voting machines. (2) Section 7 would have required published material that expressly advocates for or against a candidate or ballot question and is AI-generated to carry the disclosure "This communication was generated using artificial intelligence." (3) Section 8 would have required published election advocacy material that contains a "materially deceptive depiction" of a candidate to carry a manipulation disclosure. That covers material altered to change a candidate's appearance, to show an act that did not occur, or to change the image's saturation, brightness, contrast, color or other visible quality. (4) Section 9 would have prohibited distributing synthetic media containing a "deceptive and fraudulent deepfake" of a candidate within 90 days of an election in which the candidate appears on the ballot, if the person knows or should know of it. Exceptions would have covered clear disclaimers, bona fide news broadcasts, news websites and periodicals with disclosures, satire or parody, and interactive computer, cloud and internet service providers. A depicted candidate could seek an injunction or other equitable relief in district court. Willful violations of sections 7 and 8, and violations of section 9, would have been misdemeanors. Sections 2, 3 and 9 define terms. Section 10 would have made the act effective on passage for regulations and preparatory tasks, and on January 1, 2026 for all other purposes.
