New York Assembly Bill 907-A amends the Executive Law to require the state's council (under Section 840 of the executive law) to develop and enforce minimum standards governing the use of Automatic License Plate Reader (ALPR) systems by law enforcement. An ALPR system is defined as one or more mobile or fixed high-speed cameras combined with computer algorithms to convert license plate images into computer-readable data. Under new subdivision 10, the council must: (a) develop, maintain, and disseminate a minimum standards policy covering permissible uses, data sharing, prohibited uses, record retention, and training; (b) recommend to the governor rules for establishing and maintaining a training and periodic retraining program for all current and new police officers; and (c) require all state and local law enforcement agencies to conspicuously post the ALPR minimum standards policy on their websites or, if no website exists, in their main offices, and make it available to the public upon request. Agencies may implement standards more stringent than the minimums. The act takes effect one year after becoming law, with rulemaking authorized immediately to prepare for that effective date.
