New York Assembly Bill 9091 (2025-2026 session) has not been enacted. It was referred to the Consumer Affairs and Protection committee and held there for consideration on 2026-05-05. If enacted, it would add a new section 399-ss to the general business law, titled "Artificial intelligence disclosure." Section 399-ss(1) defines "artificial intelligence" as a machine-based system that, for human-defined objectives, makes predictions, recommendations, or decisions influencing real or virtual environments. Under 399-ss(2), when a search engine displays information generated by artificial intelligence, it must tell the user in clear, plain language, in the same font size as that information, that the information was AI-generated. The notice must appear (a) directly above the information and (b) as a watermark across it. Under 399-ss(3), any violation would carry a civil penalty of up to $5,000. Section 2 says the act would take effect on the ninetieth day after it becomes law.
