New York Senate Bill 7892-A (2025-2026) amends Section 305 of the Education Law by adding a new subdivision 33 directing the Commissioner of Education to develop and submit recommendations to the Board of Regents regarding the incorporation of artificial intelligence literacy into K-12 school curricula. The bill's legislative findings note that New York lacks an official AI literacy curriculum framework and that foundational AI knowledge is increasingly essential for workforce participation and informed citizenship. Under subdivision 33, the recommended curriculum must cover five content areas—differentiated by students' age and developmental stage—including: (i) basic concepts and functioning of AI systems; (ii) critical evaluation of AI-generated content; (iii) practical applications and limitations of AI; (iv) ethical considerations and societal impact; and (v) safe and responsible interaction with AI systems. Before submitting recommendations, the Commissioner must consult the Director of the Office of Information Technology Services, educators, administrators, parents, and students, and must also assess instructional time requirements and fiscal impacts. The Commissioner has 180 days from the effective date to submit a recommendation either to adopt or reject the curriculum. The Board of Regents must then vote within 60 days of receiving that recommendation. If adopted, the curriculum takes effect no later than the following school year, and the Board must develop guidelines covering age-appropriate content, integration into existing subjects, teacher professional development, and student competency assessments. If rejected, the Commissioner must report the reasons for rejection to the Governor and legislative leaders within 30 days. The bill defines 'AI system' as an engineered or machine-based system that infers from inputs to generate outputs influencing physical or virtual environments, and 'AI literacy' as the ability to understand, critically evaluate, and interact with AI systems.
