Restrict commercial use of license plate recognition data
Ohio H.B. No. 725 (136th General Assembly, introduced 2026-03-03 and referred to the Public Safety committee) has not been enacted. If enacted, it would create section 4549.07 of the Revised Code. Under division (B), no person could knowingly collect, use, sell, transfer, or share images, information, or other data collected from an automated license plate recognition system for commercial purposes. Division (A) defines the system as one or more mobile or fixed high-speed cameras combined with computer algorithms that can convert license plate images into computer-readable data. Division (C) exempts four things: (1) collection or use in the course of normal business activity, including insurance purposes or regulating access to private property; (2) collection, use, or sharing by a law enforcement agency or peace officer in the course of law enforcement activities; (3) collection, use, sale, transfer, or sharing by one public entity to another public entity; and (4) activity in accordance with section 149.43 or 4501.27 of the Revised Code. Under division (D), a violation of division (B) would be a misdemeanor of the first degree.
