Artificial intelligence; prohibiting distribution of certain media and requiring certain disclosures. Effective date.
Oklahoma SB 894 (Senate floor version, as amended) has not been enacted; it was reported "Do Pass as amended" by the Technology and Telecommunications Committee and placed on General Order. If enacted, it would add a new Section 401 of Title 75A, effective November 1, 2025 (Section 2). It would bar any person, corporation, committee, or other entity, within 90 days of an election, from creating or originally distributing synthetic media that it has actual knowledge is a deepfake of a candidate or political party on the state or local ballot (Section 1, subsection B). "Deepfake" is defined as realistic but false synthetic media depicting a candidate or political party, made with intent to tarnish reputation or deceive. The prohibition would not apply if the media carries a disclosure: "This ___ (image, audio, or video) has been manipulated or generated by artificial intelligence" (subsection C). For visual media, the text must be easily readable and no smaller than the largest other text, and it must stay on screen for the whole video. For audio, it must be spoken at the beginning, at the end, and at intervals of no more than two minutes. A depicted candidate could seek an injunction or other equitable relief, or sue for general or special damages, and the court may award costs and attorney fees to the prevailing party (subsection D.1). The State Election Board could also impose civil fines (subsection D.2): up to $10,000 if the violation is within five years of prior convictions, up to $5,000 if committed with intent to cause violence or bodily harm, and up to $1,000 in other cases. Subsection E lists exemptions: bona fide news broadcasts and publications that clearly note doubts about the media's authenticity, outlets paid to distribute a deepfake, broadcasters required by federal law to air candidate messages, and satire or parody.
