Providing for the use of artificial intelligence in mental health therapy and for enforcement.
Pennsylvania House Bill 1993 (2025), the proposed Artificial Intelligence in Mental Health Therapy Act, has not been enacted. It was referred to the House Professional Licensure Committee on 2025-10-24. If enacted, it would limit how AI is used in mental health therapy. Section 3 would bar a mental health professional from using AI for supplementary support (such as records, therapy notes, or anonymized progress analysis) in sessions that are recorded or transcribed. The exception is when the patient or their legally authorized representative is told in writing that AI will be used and for what specific purpose, and also gives consent. Section 4 would bar AI providers from representing, or knowingly programming a system to represent, that the AI can provide therapy or psychotherapy. It would also bar them from presenting the AI as a therapist, counselor, psychiatrist, doctor, or other mental health provider. AI providers could not make available in Pennsylvania a system specifically programmed to provide a service that would be the practice of a mental health professional if a person provided it. Licensed professionals could not let AI make independent therapeutic decisions, directly engage in therapeutic communication with clients, generate treatment recommendations or plans without professional review and approval, or detect emotions or mental states. Section 5 would make violations unprofessional conduct under the licensing laws for nurses, psychologists, osteopathic physicians, physicians, and social workers, marriage and family therapists, and counselors. Section 6 would exempt religious counseling, peer support, and public self-help or educational materials that do not purport to offer therapy. Section 7 would make the act take effect 60 days after enactment.
