Pennsylvania House Bill 2678 (2026) has been referred to the House Professional Licensure Committee and has not been enacted. If enacted, it would amend Title 63 (Professions and Occupations) by adding definitions of "artificial intelligence" and "generative artificial intelligence" to § 3102. It would also add a new § 3107.2 requiring every licensing board and licensing commission to establish rules on licensees' use of AI when providing services within their authorized scope of practice. The rules must be consistent with the applicable practice act. At a minimum, the rules must cover: (1) conditions under which AI may be used; (2) the level of review, supervision or approval needed before AI output is relied upon; (3) plain-language disclosure to the person receiving services, including its manner, content and timing, when services or work product are generated in whole or in substantial part by AI; (4) a right for each person receiving services to communicate directly with a licensee rather than solely through AI, and the process for exercising it; (5) licensee duties, including professional judgment and compliance with ethical, confidentiality and recordkeeping obligations despite AI use; (6) limits, including that AI may not independently perform professional services, make professional decisions, establish a professional relationship or fulfill a licensee's duty; and (7) when AI use may be unprofessional conduct, a practice act violation or grounds for discipline. Section 3107.2(c) says the section does not limit boards' existing authority to regulate AI use, and does not require disclosure for purely administrative, clerical or ministerial functions that involve no individualized professional advice, recommendations, evaluations, treatment, analysis or decisions. Section 3107.2(d) allows boards to promulgate implementing regulations. Under Section 3, the act would take effect 60 days after enactment.
