Pennsylvania House Bill 431 (2025) has not been enacted; it was referred to the Communications and Technology Committee on January 31, 2025. If enacted, it would add 18 Pa.C.S. § 4122, creating the crime of unauthorized dissemination of an artificially generated impersonation of an individual. Under § 4122(a), a person commits the offense by disseminating an artificially generated impersonation of an individual without that individual's consent, while knowing or having reason to know or believe it was artificially generated. Under § 4122(b), the offense is a first-degree misdemeanor, or a third-degree felony if committed with intent to defraud or injure another person. Section 4122(c) provides a defense to prosecution under subsection (b)(1) if the person disseminated it with the consent of the individual depicted. Under § 4122(d), a person may be convicted if the victim or the offender is located in Pennsylvania. Under § 4122(e), the section does not apply to law enforcement officers performing official duties. Section 4122(f) defines "artificial intelligence" and "artificially generated impersonation." The latter means a visual image or auditory vocalization resembling an individual's voice that did not occur in reality and whose production depended substantially on technical means such as AI or software, rather than on a person physically mimicking another. Section 2 sets the effective date at 90 days after enactment.
